Education Acts
Check your provincial legislation for transportation policies. This one is Ontario’s policy from its Education Act. Those from other provinces/territories will be added eventually. The following is taken from the section on transportation. Please note use of the word “may” as opposed to “shall.”
Transportation of pupils
190. (1) A board may provide for,
(a) a pupil who is enrolled in a school that the board operates; transportation to and from the school that the pupil attends. R.S.O. 1990, c. E.2, s. 190 (1); 1997, c. 31, s. 96 (1).

Description:
“This grant provides school boards with funding in order to transport students to and from home and school, including transporting students with special needs. The Student Transportation Grant is made up of five allocations, with the total Student Transporation Grand projected to be $864.6 million in 2010-11:
- Cost Update Adjustment Allocation;
- Enrolment Adjustment Allocation;
- Routing Efficiency Allocation;
- Fuel Escalator and De-escalator Allocation; and
- Transportation to Provincial Schools Allocation.
Cost Update Adjustment Allocation:
- This allocation recognizes a cost increase of 2 percent for providing transportation
services; - Boards with a transportation deficit in the 2009–10 school year will receive the cost
update adjustment; - Boards with a transportation surplus in the 2009–10 school year, and a cost update
adjustment that is more than their surplus, will receive the difference between their
surplus and the cost update adjustment; and - Boards with a transportation surplus in the 2009–10 school year, and a cost update
adjustment that is less than their surplus will not receive a cost update adjustment.
